Terms of Service

These Terms of Service ('Terms') constitute a legally binding agreement between you ('User') and Francesco Agnoletto, an individual operating Structura Planner ('we', 'us', or 'our'), governing your access to and use of the Structura Planner web application available at structuraplanner.com.

By accessing or using Structura Planner, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the service. Use of the service by anyone under 18 years of age is not permitted without parental consent.

Structura Planner is a guided project planning tool for Business Analysts. It allows users to structure projects using the BABOK® v3 (Business Analysis Body of Knowledge, version 3) framework. The tool walks users through six Knowledge Areas, enabling them to select techniques, configure deliverables, and export a complete project plan in Markdown format.

The service is offered in two tiers: - Free Tier: Access to core planning functionality, limited to one active project. - Pro Tier: Full access with support for up to ten active projects, available via a monthly or annual subscription.

To access Structura Planner, you must register for an account using a valid email address. Authentication is handled via AWS Cognito, a third-party identity service operated by Amazon Web Services.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at hello@structuraplanner.com if you suspect unauthorised access to your account. We are not liable for any loss or damage arising from your failure to keep your credentials secure.

You must provide accurate and current information during registration. Accounts created with false information may be suspended or terminated.

Payments are processed by Paddle.com Market Limited ('Paddle'), who acts as the Merchant of Record for all purchases. Your purchase agreement is with Paddle, not with Structura Planner directly. Paddle's checkout buyer terms apply to all transactions.

Pro Tier pricing: - Monthly plan: EUR 4.99 per month - Annual plan: EUR 39 per year (billed annually)

Subscriptions renew automatically via Paddle at the end of each billing period. You will be charged using the payment method on file with Paddle. Paddle may apply taxes based on your location, including VAT where applicable under EU law.

You can manage your subscription and billing details through the billing portal accessible from your account. All payment disputes and chargebacks must be directed to Paddle as the Merchant of Record.

The Free Tier allows you to use Structura Planner at no cost, subject to a limit of one active project at any time. Free Tier access does not require a payment method.

We reserve the right to modify Free Tier limitations at any time with reasonable notice. If you already have a project under the Free Tier at the time of any such change, you will not be required to delete it immediately.

The Pro Tier is a paid subscription that unlocks support for up to ten simultaneous active projects. Pricing: - Monthly plan: EUR 4.99 per month - Annual plan: EUR 39 per year (billed annually)

Pro Tier subscribers retain access to all Pro features for the duration of the active subscription period. If a Pro subscription is cancelled or lapses, the account reverts to Free Tier limits. Projects exceeding the Free Tier limit will be read-only until the account is upgraded again or the project count is reduced.

You may cancel your Pro Tier subscription at any time through the billing portal in your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to Pro Tier features until the period concludes.

No partial refunds are issued for unused time in a billing period upon cancellation. For refund requests within the applicable window, please refer to our Refund Policy at /refund.

We reserve the right to suspend or permanently terminate your account if you: - Violate any provision of these Terms - Engage in fraudulent activity or attempt to manipulate the service - Abuse the Free Tier (e.g., creating multiple accounts to circumvent the single-project limit) - Act in a way that could harm the service or other users

In cases of termination for cause, you will not be entitled to a refund of any prepaid subscription fees. We will notify you by email where reasonably practicable prior to or at the time of termination.

You may permanently delete your account at any time from the Account settings page at /account. Account deletion is irreversible and will: - Remove all project data stored in our database - Delete your user record from AWS Cognito - Cancel any active subscription with Paddle (effective at period end)

Following account deletion, we retain no personally identifiable data about you except where required to do so by law (e.g., financial records related to Paddle transactions, which are held by Paddle as Merchant of Record).

All content you create within Structura Planner — including project names, technique selections, notes, and exported documents — belongs to you. We do not claim ownership of your project data.

All software, design, source code, documentation, trademarks, and brand elements of Structura Planner are owned by Francesco Agnoletto and protected by applicable intellectual property law. You may not copy, reproduce, distribute, or create derivative works from any part of the Structura Planner application without express written permission.

To the maximum extent permitted by applicable law, Francesco Agnoletto and Structura Planner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service, including but not limited to loss of data, loss of revenue, or loss of business opportunities.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid for the service in the twelve months preceding the event giving rise to the claim, or EUR 10, whichever is greater.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. EU consumer rights are not affected.

The Structura Planner service is provided 'as is' and 'as available' without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or free from harmful components. We do not warrant that any content generated or exported by the service is accurate, complete, or legally sufficient for your specific professional purposes. The BABOK® v3 framework content used as a reference within the tool remains the intellectual property of IIBA (International Institute of Business Analysis).

We may update these Terms from time to time to reflect changes to the service, legal requirements, or business practices. When we make material changes, we will notify you by email to the address associated with your account, or via an in-app notice.

Your continued use of Structura Planner after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the service and may delete your account.

These Terms are governed by and construed in accordance with the laws of Italy. Any disputes arising under or in connection with these Terms shall be subject to the jurisdiction of the courts of Treviso, Italy.

Notwithstanding the above, nothing in these Terms affects your statutory rights as an EU consumer. EU consumer protection laws — including those of your country of residence — apply to the extent they provide protections that cannot be waived by contract.
